A McAlester man federally indicted after locking a woman in a dog cage and assaulting her for 36 hours in 2022 is set to be sentenced Monday, with prosecutors asking for nine and a half years imprisonment as part of a plea agreement.
Cody Ray McFadden, 36, was originally federally indicted on Aug. 8, 2022, in the Eastern District of Oklahoma on charges of kidnapping, maiming, assault with a dangerous weapon with intent to do bodily harm, and assault resulting in serious bodily injury.
McFadden pleaded guilty to a single charge of maiming in Indian Country in December 2024 after entering into a plea agreement with federal prosecutors with a possible sentencing range between seven to 10 years in federal prison.
A sentencing memorandum filed in the case on April 11 states McFadden’s history supports a prison sentence of nine and a half years and says what he did to the victim “is everyone’s worst nightmare.”
“The only reason this is not a murder case is that (the victim) was able to make a miraculous escape by jumping through a closed window,” the document states. “Defendant showed a complete disregard for human life, and the Court’s sentence should reflect the depravity of his behavior on the offense date.”
An affidavit filed in the case states McFadden invited the victim over for something to drink when he locked the front door of the residence and when the victim tried to leave, McFadden punched the victim in the face and beat her with a fiberglass rod for 30 minutes before he put the victim in a dog cage.
“Defendant then padlocked the cage and, for the next thirty-six hours, tortured (the victim) while she was locked inside. Defendant poked her with the fiberglass rod, attempted to shock her with an extension cord, sprayed her with mace, spit on her, and pointed a crossbow in her direction while stating he was going to shoot her,” court documents state. “At one point during this abuse, Defendant hit the cage with an axe, which damaged its structure. (The victim) was then able to break free, run to a nearby window, and jump outside. During this process, Defendant swung at (the victim) with the axe, contacting her head.”
Following a standoff with law enforcement, McFadden was taken into custody.
Records show McFadden is scheduled to be sentenced Monday, April 28, at the federal courthouse in Muskogee.
