McAlester Man Injured After Alleged Assault by Brother with Violent Criminal History

A McAlester man was injured Thursday, June 19, after allegedly being assaulted by his brother during a dispute over a weed eater, police said.

According to an affidavit, officers arrived at a residence to find the victim with a cut above his left eye and holding a blood-stained towel. He declined medical treatment and told police his brother, Horace Spencer, 50, punched him multiple times after an argument about the location of Spencer’s weed eater.

The victim said he was on the phone with their mother during the exchange, and the assault allegedly began shortly after the call ended. Spencer had left the scene before officers arrived.

A domestic abuse report was filed, and officers submitted a probable cause affidavit. Attempts to locate Spencer at his residence were unsuccessful at that time. However, Spencer was arrested shortly after and given a $50,000 bond.

According to court records, Spencer has multiple violent felony convictions. In 2009, he was sentenced to 20 years with 10 suspended for assault and battery with a dangerous weapon and domestic assault by strangulation. He was also convicted in 1999 of drive-by shooting and weapons charges, and in 1995 of assault with a dangerous weapon after a previous felony.
